In order to get into free form mode on the cork board, do the documents have to be in a folder ?

Yes, or you can place any documents you want in an arbitrary collection and click on the header bar of the collection to open that in the corkboard, and then enter freeform mode for that (with a collection, you can have arbitrary documents in freeform mode that are from different folders).
