I have been using Scrivener for a while - although no expert. Today the background has become yellow see screenshot. I have tried toggling highlighter and this makes other areas yellow/not yellow. As you can see the yellow is where there is no text.
I have updated and tried a new project but it continues. Would appreciate help.

It looks like the text highlight has recently been set in the default formatting, so it’s not affecting the existing document text but it is displaying as the formatting surrounding the Scrivenings separators, just from the nature of how they’re inserted into a session for a visual divider between sections.
I’d check the Editing pane under Scrivener ▸ Preferences
and see what the sample text looks like in the Formatting tab. You can use the format bar there to remove the highlight, and that will fix it showing up on the Scrivenings separators.
You’d need to manually remove it from any text in new documents created with the highlight as part of the default formatting, but I’m guessing there aren’t any where this is an issue or you’d have noticed the highlight.
